WHEELING – An Ohio man who worked in West Virginia is suing his ex-employer over the alleged unsafe conditions that caused his workplace injury.
Stephen Miedel and his wife, Misty, filed a lawsuit March 14 in Ohio Circuit Court against Environmental Protection Services Inc., alleging deliberate violations of state and federal safety rules, as well as failure to preserve evidence.
According to the complaint, Miedel slipped and fell 15 feet from a ladder while working for EPS on March 18, 2014. As a result of the fall, the suit says, Miedel has incurred medical expenses to treat his concussion and injuries to his knee, chest and shoulder, and has been unable to work since the incident.
The complaint further states that EPS not only violated OSHA and other regulations which led to the accident, but also hindered a proper investigation by allegedly destroying the ladder he fell from.
The Miedels seek a jury trial and punitive and compensatory damages, plus interest and litigation costs. They are represented by attorney Eric T. Chaffin and Patrick C. Booth of Chaffin Luhana LLP in Weirton. Judge David J. Sims is assigned to the case.
