Company blames contractor for alleged building defects

WHEELING – An Ohio County company is suing a Pennsylvania firm for allegedly failing to properly finish construction of a building addition.

NRUS LLC filed a lawsuit March 14 in Ohio Circuit Court against Arcon Group Inc., alleging breach of contract.

According to the complaint, the parties entered into a construction contract on Aug. 19, 2014, whereby Arcon would supply labor, materials, supervision and contract administration to complete a one-story office building addition in Valley Grove. The suit says Arcon breached its contract with NRUS by not completing the work in a satisfactory manner, forcing NRUS to pay $106,369 for repairs.

NRUS seeks recovery of the $106,369 it allegedly paid to fix the building, plus accrued interest of $9,307 and attorneys’ fees of $5,465. It represented by attorney Arch W. Riley Jr. and Arthur W. Zamosky of Bernstein-Burkley P.C. in Wheeling. Judge David J. Sims is assigned to the case.
