Freight company accuses coal customer of failing to pay for shipping

LOGAN – A Logan County freight contractor is suing two coal companies for allegedly failing to pay money owed under a transportation contract.

Transporters LLC filed a lawsuit March16 in Logan Circuit Court against Producer’s Land-WV LLC and Producer’s Coal Inc., alleging breach of contract.

According to the complaint, in September of 2015, the parties struck an agreement whereby Transporters would haul coal needed for the defendants’ operations. Although Transporters claims it completed the work on time and in a professional manner, the suit says they never received payment for the transportation services they provided.

Transporters seeks a jury trial and damages of $238,276, the entire amount owed under the contract, plus litigation costs. It is represented by attorney Brian R. Abraham of Abraham & Ilderton PLLC in Logan. Judge Eric H. O’Briant is assigned to the case.
