Firm accuses customer of owing unpaid credit balance

BECKLEY – A Kanawha County company is suing a Raleigh firm for allegedly failing to pay money owed under a credit agreement.

Cecil I. Walker Machinery Co. filed a lawsuit March 17 in Raleigh Circuit Court against Poncove Inc., alleging breach of a credit agreement.

According to the complaint, Poncove applied for credit with the plaintiff on May 25, 2011 to rent equipment, obtain services and purchase goods. The suit says Poncove became delinquent in repayment of its credit account beginning in April of 2014, and now owes a balance of $307,942 despite multiple demands for payment.

Walker Machinery seeks recovery of the entire amount owed, plus interest at the rate of 7 percent and all litigation costs. It is represented by attorney Jerred P. Roth of Burton Neil & Associates P.C. of Mineral Wells.

Judge John A. Hutchison is assigned to the case.
