Creditor accuses firm of loan default, hiding collateral

BECKLEY – A Raleigh County firm says a company it loaned money has defaulted on the loan and has hidden the property pledged as collateral.

Eagle Coal Sales Inc. filed a lawsuit March 3 in Raleigh Circuit Court against West Star Management Inc., alleging breach of contract.

According to the complaint, as of Feb. 19, 2016, West Star has defaulted on a $14,000 loan from Eagle Coal Sales for which it pledged as collateral a 2004 Peterbilt tractor. The suit is also petitioning to confiscate the tractor, which allegedly has been moved to an unknown location, until the loan is paid in full.

Eagle Coal Sales seeks recovery of the full loan amount plus pre- and post-judgment interest and litigation fees. It is represented by attorney Carl W. Roop of Roop & Smith Law Office PLLC in Beckley. Judge H.L. Kirkpatrick III is assigned to the case.
