WHEELING – A New Jersey firm claims a West Virginia company owes thousands of dollars for materials purchased under a credit agreement.
ABC Supply Co. Inc. filed a lawsuit March 11 in Ohio Circuit Court against Jones Roofing LLC and its president/owner, Matt Jones, alleging breach of contract.
According to the complaint, although Jones signed a credit agreement on behalf of Jones Roofing, he and his company have refused to pay for $23,247 of materials ABC Supply sold them as of Feb. 29, 2016. The suit says the credit agreement stipulated interest of 18 percent per annum on past due balances, and that ABC could recover attorney’s fees incurred in collecting delinquent accounts. ABC Supply also states that Jones signed a personal guaranty for all amounts owed.
ABC Supply seeks recovery of the amount owed, plus interest accruing from Feb. 29 and litigation costs. It is represented by attorney W. Scott Stinnett of Lloyd & McDaniel PLC in Louisville, Ky.
