Two lawsuits filed by MedMatrix Solutions for breach of contract

BECKLEY – Two lawsuits have been filed by MedMatrix Solutions against two medical offices and a doctor it claims breached contracts with the company.

Responsible Pain & Aesthetic Management PLLC; Dr. J. Jorge Gordinho; and Medical Associates of Glen Daniel PLLC were named as defendants in the suits.

MedMatrix and the defendants are parties to two medical billing services agreements whereby MedMatrix provides medical billing and/or related services and the defendants agreed to pay seven percent of net monthly collections and postings on patient accounts, according to two complaints filed March 2 and March 7 in Raleigh Circuit Court.

MedMatrix claims it has submitted invoices to MAGD for services rendered in the amount of $5,297.35 and to RPAM for services rendered in the amount of $74,147.49.

The defendants had a duty to pay for the services they received in a timely manner and has failed and refused to pay, which is in breach of the contract between the parties, according to the suits.

MedMatrix claims after 30 days, interest accrues at the rate of 1.5 percent on any outstanding balance, as per Section 4.4 of the contract.

The defendants have been unjustly enriched at MedMatrix’s expense, according to the suits.

MedMatrix claims that Gordinho exerted extreme domination over RPAM and MAGD to the extent that they were a mere instrumentality and alter ego of Gordinho and he is personally liable as an alter ego for their actions, failure to act, debts and obligations.

MedMatrix is seeking judgment for the amounts of $5,297.35 and $74,147.49 with pre- and post-judgment interest. It is being represented by Ramona C. Lyons of Lewis, Glasser, Casey & Rollins PLLC.
