WINFIELD – A Michigan couple is suing a truck stop’s owners over injuries allegedly caused by a parking lot pothole.

Shari Foster and her husband Alan Foster filed a lawsuit March 17 in County Circuit Court against TA Operating LLC, doing business as Travelcenters of America, alleging negligence and premises liability.

According to the complaint, as Shari Foster exited the couple’s commercial truck at the TA Truckstop in Hurricane on Oct. 7, 2014, she stepped into a pothole, injuring her foot. The suit says the truck stop’s owners are liable for her injuries because they neglected their duty to provide safe premises for customers.

The Fosters seek a jury trial and compensatory damages, plus interest and attorneys’ fees. They are represented by attorney G. Wayne Van Bibber of The Law Offices of G. Wayne Van Bibber & Associates PLLC in Hurricane.
