Motorists accuse State Farm of failing to settle claim

CHARLESTON – A Putnam County couple is suing their insurer, claiming the company refused to settle a $100,000 claim for an auto wreck.

Barbara A. Miller and Troy W. Miller filed a lawsuit March 10 in Kanawha Circuit Court against State Farm Mutual Automobile Insurance Co., alleging negligence, prima facie negligence and loss of consortium.

According to the complaint, the Millers sustained serious bodily injuries when their Cadillac was struck by a Hyundai Sonata driven by Ray Propps on July 26, 2013. Although Troy Miller settled with Propps’ insurer and State Farm, the suit says Barbara Miller’s settlement of $19,200 from Propps’ insurer did not cover her medical expenses. The Millers’ policy with State Farm includes $100,000 of underinsured coverage, but they claim they have been unable to reach a settlement for underinsured coverage and loss of consortium.

The Millers seek a jury trial and compensatory damages, plus pre- and post-judgment interest and attorneys’ fees. They are represented by attorneys Robert D. Cline Jr., Robert A. Campbell, Letisha R. Bika and George E. Chamberlain IV of the law firm of Farmer, Cline & Campbell PLLC in Charleston.

Judge James C. Stucky is assigned to the case.
