State accuses company of negligence over bridge damage

CHARLESTON – The West Virginia Department of Transportation is suing a private company to recover costs the state allegedly paid to clean up a fuel spill.

The West Virginia Department of Transportation, Division of Highways, and its commissioner, Paul A. Mattox Jr., filed a lawsuit March 9 in Kanawha Circuit Court against DSI Bulk Transport Inc., alleging negligence.

According to the complaint, a truck owned by DSI was traveling on Buckeye Run Road (Route 50/29) in Doddridge County when it accidentally left the road, striking a concrete bridge and rail. The plaintiffs claims the resulting damage to the bridge cost $8,878.

The plaintiffs seek reimbursement for the repair costs, plus interest and litigation costs. They are represented by attorneys Chad M. Cardinal and C. Brian Matko of the West Virginia Department of Transportation. Judge Charles E. King is assigned to the case.
