State blames overpass damage on transport firm

CHARLESTON – The state of West Virginia is suing a company for its alleged involvement in an accident that damaged a public bridge.

The West Virginia Department of Transportation, Division of Highways, and its commissioner, Paul A. Mattox Jr., filed a lawsuit March 9 in Kanawha Circuit Court against Cross Roads Transport Inc., alleging negligence.

According to the complaint, a truck owned by Cross Roads was traveling on Dallas Pike Road (Route 41) in Ohio County on April 22, 2014 when its cargo load became stuck, damaging an overpass structure. The suit says Cross Road’s vehicle lacked proper permits and flagging vehicles to ensure safe travel on that section of road. The DOT says damages to the overpass totaled $173,906.

The plaintiff seeks recovery of the repair costs, plus interest and litigation costs. They are represented by attorney Chad M. Cardinal and C. Brian Matko of the DOT.

Judge Louis H. “Duke” Bloom is assigned to the case.
