HUNTINGTON – A 72-year-old Cabell County woman is suing her bank in an attempt to prevent foreclosure and make the monthly payments permanently more affordable.
Doris L. Hammock filed a lawsuit March 11 in Cabell Circuit Court against The Huntington National Bank, alleging violations of good faith and fair dealing and deceptive business practices.
According to the complaint, the state of West Virginia awarded Hammock custody of her minor grandchildren in 2015, forcing her to quit her part-time job and making house payments on her Social Security income impossible. To keep the house, the suit says Hammock tried to get a loan modification to permanently reduce her monthly payments. However, she states that Huntington Bank said she could not receive another modification, and moved to foreclose on her home. She also claims Huntington manipulated the due date on her account to collect erroneous late fees.
Hammock seeks a jury trial and actual and compensatory damages, plus legal expenses. She is represented by attorney Gary M. Smith of Mountain State Justice Inc. in Charleston.
Judge Christopher D. Chiles is assigned to the case.
