Trucking company sued for alleged failure to pay

HUNTINGTON – A Cabell County company is suing a customer for allegedly failing to pay for repair work performed on its fleet of commercial trucks and trailers.

Matheny Motor Truck Co. filed a lawsuit Feb. 29 in Cabell Circuit Court against L.J. Navy Trucking Co., alleging unjust enrichment.

According to the complaint, between April and September of 2013, Matheny sold L.J. Navy auto parts and performed repairs on its trucks and trailers. Although L.J. Navy never complained about the workmanship or materials Matheny sold them, the suit says they have left numerous invoices unpaid, totaling $48,597.

Matheny seeks recovery of the amount owed, plus interest and litigation costs. It is represented by attorneys John R. Hoblitzell, John D. Hoblitzell III and Lindsay M. Gainer of Kay Casto & Chaney PLLC in Charleston.

Judge Christopher D. Chiles is assigned to the case.
