PINEVILLE – Insurance giant State Farm is suing an Oceana business whose driver allegedly caused an accident injuring a policyholder.
State Farm Mutual Automobile Insurance Co. filed a lawsuit March 31 in Wyoming Circuit Court against Ellis Lumber Company of Oceana Inc., alleging negligence.
According to the complaint, a flatbed truck driven by an Ellis Lumber employee struck Linda Alfrey’s 2008 Mercury Milan, a vehicle insured by State Farm. The suit says Alfrey suffered vehicle damage and bodily injury from the April 8, 2014 collision, and received a settlement from State Farm for $13,608.
The plaintiff seeks recovery of the full settlement amount, plus pre- and post-judgment interest and costs. It is represented by attorney Christopher P. Deegan of Weber Gallagher Simpson Stapleton Fires & Newby LLP in Pittsburgh. Judge Warren R. McGraw is assigned to the case.
