Firm accuses accountant of negligence, breach of duty

BECKLEY – A Raleigh County company is suing its accounting firm, claiming it failed to provide the services it was hired to perform.

New River Hardwoods Inc. filed a lawsuit March 24 in Raleigh Circuit Court against Hess, Stewart & Campbell PLLC, Charles A. Cook and Todd A. Robinson, alleging breach of contract, negligence and breach of fiduciary duty.

According to the complaint, the parties signed agreements in 2010 and 2011 whereby the Hess firm would audit the plaintiff’s year-end balance sheet and statements of income, retained earnings and cash flow, and prepare federal tax returns. The suit says New River’s chief financial officer was misappropriating the company’s funds during the years in question, but the Hess firm failed to detect the impropriety.

New River Hardwoods seeks a jury trial and punitive and compensatory damages, as well as interest and litigation costs. It is represented by attorney James S. Crockett Jr. of Spilman Thomas & Battle PLLC in Charleston.
