Worker blames injuries on customer’s negligence

WINFIELD – A Maryland man is suing his employer’s customer for injuries he allegedly suffered while delivering products to its facility.

Thomas Upole filed a lawsuit March 28 in Putnam Circuit Court against AZZ Delaware LLC, doing business as AZZ Galvanizing-Pilot, also known as AZZ Inc., AZZ Galvanizing, alleging negligence.

According to the complaint, Upole was delivering cargo of steel bars and rollers on May 27, 2014 to AZZ Delaware’s Putnam County facility when he was struck in the head, neck and back. The suit says negligence on the part of the defendant’s workers caused the cargo to fall from the truck. As a result of the accident, Upole says he suffered permanent injuries and disability, as well as diminished earning capacity.

Upole seeks damages in excess of $75,000. He is represented by attorney David E. Furrer of Siegel, Tully & Furrer in Cumberland, Maryland.
