KINGWOOD – A Preston County property owner says a lessee allowed preventable vandalism to its property, and that an insurance company is refusing to cover the damages.
Westridge Estate LLC filed a lawsuit March 30 in Preston Circuit Court against Preston Funeral Enterprises LLC and Hartford Casualty Insurance Co., alleging breach of contract, negligence and first-party bad faith.
According to the complaint, Westridge leased property it owns at 106 Highland Drive in Kingwood to Preston Funeral on June 24, 2014, stipulating that the property be maintained in its original condition and that liability insurance be in place. On Jan. 20, 2015, the property was vandalized, the suit says, damaging Westridge’s personal property. Although Westridge was covered by the insurance in place at the time, the plaintiff says Hartford refuses to compensate them for the damage.
Westridge seeks a jury trial punitive and compensatory damages, interest, and litigation fees. It is represented by attorney Lance E. Rollo of Morgantown.
