Truck buyer accuses Ford Motor Co., dealer of warranty breach

KINGWOOD – A Monongalia County man says the Ford F550 truck he bought is defective and unusable, despite undergoing warranty repairs.

Roger A. Powers filed a lawsuit March 24 in Preston Circuit Court against Ford Motor Co.; The Auto Source of West Virginia Inc., doing business as Scott Ford; and Wood Holdings 4 LLC, doing business as Freedom Ford Lincoln of Morgantown; alleging breach of express and implied warranties.

According to the complaint, Powers purchased a new 2012 Ford F550 truck from the Scott Ford dealership on July 12, 2012, for $58,019. The suit says upon delivery, the vehicle contained defects under warranty that impaired its use, value and safety. Despite several attempts at repair by the defendants, Powers says the vehicle remains defective and unusable.

Powers seeks a jury trial, recovery of the vehicle’s purchase price, compensation for expenses and annoyance, and litigation costs. He is represented by attorney Matthew T. Thorn of Sal Sellaro Thorn Culpepper Legal Group PLLC in Morgantown.
