MOUNDSVILLE – A Marshall County couple is suing a gas station, claiming the wife was injured from being struck in the head by a metal object while exiting the store.
Kerri Jo Wise and her husband, Albert Wise, filed a lawsuit March 28 in Marshall Circuit Court against Tri-State Petroleum Corp., alleging negligence and premises liability.
According to the complaint, as Kerri Jo Wise was leaving the defendant’s Marathon gas station on June 21, 2015, a weighted metal object believed to be a door chime fell and struck her in the head. The suit blames Tri-State Petroleum for failing to secure the object and leaving the store unsafe for customers. Wise says she suffered wounds to her head and neck, some of which may be permanent and have diminished her earning capacity.
The Wises seek a jury trial and punitive and compensatory damages, plus interest and litigation costs. She is represented by attorney J. Zachary Zatezalo of Bordas & Bordas PLLC in Wheeling. Judge Jeffrey Cramer is assigned to the case.
