Shopper blames Kroger for whipped cream topping injuries

MOUNDSVILLE – A Marshall County man says he was injured at a Kroger store when a can of whipped cream topping fell out of a cooler, striking him in the face.

Carl Nelson Hooker filed a lawsuit March 14 in Marshall Circuit Court against The Kroger Co., alleging negligence and premises liability.

According to the complaint, Hooker was shopping at the Moundsville Kroger store on March 26, 2014 when the incident occurred. The suit blames Kroger for failing to ensure a safe environment for customers. As a result of his injuries, Hooker incurred ongoing medical expenses, pain and mental anguish.

Hooker seeks a jury trial and punitive and compensatory damages, plus interest and litigation costs. He is represented by attorney Ronald Wm. Kasserman of Kasserman Law Offices PLLC in Wheeling.

Judge Jeffrey Cramer is assigned to the case.
