LOGAN – A Kanawha County man says his ex-employer deliberately exposed him to unsafe working conditions, leading to serious, permanent injuries.
Rodney Stine filed a lawsuit March 22 in Logan Circuit Court against Welding Inc., alleging deliberate negligence.
According to the complaint, Stine was hired by Welding to sandblast and paint a water tank in Logan County on Aug. 5, 2014, requiring him to be lifted in a basket to gain access to the upper portions of the tank. As he scaled the 6-foot perimeter fence surrounding the tower, the suit says he fell and was struck by the basket, which weighed several hundred pounds. Since the fall, the plaintiff says he has suffered from vertigo, damage to the chest, and worsening of prior spinal damage.
Stine seeks a jury trial and compensation for medical costs, pain and suffering, and diminished earning capacity. He is represented by attorneys Guy R. Bucci and Ashley N. Lynch of the Bucci Law Firm in Charleston.
Judge William Douglas Witten is assigned to the case.
