PINEVILLE – A Wyoming County man is suing his mortgage lender, claiming the company broke credit protection laws in an effort to foreclose on his home.
Douglas H. Short filed a lawsuit April 4 in Wyoming Circuit Court against Wells Fargo Bank N.A., alleging unlawful debt collection under the West Virginia Consumer Credit Protection Act.
According to the complaint, Short filed for bankruptcy in in 2008 following his layoff as a coal miner. Although he contacted Wells Fargo for a loan modification several times between 2009 and 2015, the suit says the bank refused the request, threatening foreclosure several times. Short claims Wells Fargo misapplied his payments and failed to apply partial payments, allegedly in a scheme to foreclose on the home.
Short seeks actual and punitive damages, cancellation of the debt, retraction of negative information on his credit report, and litigation costs. He is represented by attorneys Anthony J. Majestro and J.C. Powell of Powell & Majestro PLLC in Charleston.
Judge Warren R. McGraw is assigned to the case.
