Homeowner accuses mortgage servicer of failing to provide documentation

BECKLEY – A Raleigh County man is suing his mortgage servicer for allegedly failing to provide loan documentation.

Matthew D. Brooks filed a lawsuit April 5 in Raleigh Circuit Court against Pioneer Community Bank Inc., alleging breach of contract.

According to the complaint, three years after taking out a mortgage with Pioneer Community Bank, Brooks requested a statement of account and the name of the holder of the loan. Although Brooks requested the documents on Oct. 29, 2015, the suit says Pioneer has never responded.

Brooks seeks actual damages, civil penalties and litigation costs. He is represented by attorneys Sarah K. Brown, Bren J. Pomponio and Daniel F. Hedges of Mountain State Justice Inc. in Charleston.
