Woman accuses C&O of wrongful termination, discrimination

CHARLESTON – A Kanawha County woman is suing Moses Chevrolet after she claims she was fired from her job based on her race.

Randy Wheeler is also named as a defendant in the suit.

Moses Chevrolet is doing business as C&O Chevrolet and C&O Used Cars and Trucks.

Hiroko Bostic was a 23-year loyal employee of C&O and never received any write ups, discipline or reprimand of any kind through the course of her employment, according to a complaint filed April 1 in Kanawha Circuit Court.

Bostic claims she was told on numerous occasions that her job was secure and the sale and takeover of the former car dealership by Moses would not affect her employment.

The plaintiff served as a receptionist for C&O Motors and also took on various other duties that serviced the best interest of the company, according to the suit.

Bostic claims on March 4, she was called to the service center with virtually every other current employee of the former business and they were told as a group that all their jobs were secure and that benefits that were already in place would not be altered by the takeover.

On March 7, Bostic was called into Wheeler’s office and fired and was not given any explanation for her surprise termination, according to the suit.

Bostic claims prior to the firing, Wheeler had referred to her as “Hong Kong Whore,” “Dumb Jap,” “Jap” and “Gook,” and all of which comments were made to other employees about her race.

The defendants violated the West Virginia Human Rights Act and West Virginia code, according to the suit.

Bostic is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Lia DiTrapano Fairless of DiTrapano Law Firm.

The case is assigned to Circuit Judge Charles King.
