Company accuses law firm of practicing in state where it is not licensed

KEYSER – A Mineral County company is suing a Wisconsin law firm for allegedly damaging their credit rating despite not being licensed to practice in West Virginia.

Michael Brothers Enterprises LLC, doing business as Clancy’s Irish Pub, and Nelson M. Michael and Dan (Daniel) Michael filed a lawsuit April 7 in Mineral Circuit Court against Reinhart Foodservice LLC, Phillip James Addis and Main Street Law Offices LLC.

According to the complaint, on Feb. 19, 2006 the defendants tried to enforce a judgment levied by a Wisconsin court against the plaintiffs. However, the suit says, the attempt at enforcement was unlawful, since neither Addis nor Main Street Law are licensed to practice in the state of West Virginia. The defendants’ actions have allegedly damaged Clancy’s credit rating and borrowing capacity.

The plaintiffs seek a jury trial, compensatory damages, plus interest and legal fees. They are represented by attorney David Collins of the law firm of Nelson M. Michael L.C. in Keyser.
