Homeowners accuse contractor of negligence

MOUNDSVILLE – A Marshall County couple is suing a contractor for allegedly building a defective concrete retaining wall and then failing to make the promised repairs.

John and Jessica Dobbs filed a lawsuit in Marshall Circuit Court against Trigg Construction Home Improvement LLC and its agent Rudy Parsons, alleging negligence and breach of contract.

According to the complaint, the Dobbses hired Trigg Construction on June 25, 2013 to make a number of improvements to their home, including construction of a concrete retaining wall. However, the suit claims that once work had finished, the wall began to shift. After an inspection, Trigg Construction allegedly promised to repair the defects once weather had improved. The plaintiffs say no repairs have been made in the two and a half years since construction ended, and that they will owe an additional $38,450 to fix the wall.

The Dobbses seek compensatory damages, interest and litigation costs. They are represented by attorney Andrea C. Poling of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville. Judge Jeffrey Cramer is assigned to the case.
