Worker blames trucking company for on-the-job injuries

CHARLESTON – A Kanawha County man is suing his employer for allegedly failing to maintain a vehicle in proper working order, which he says caused him to suffer serious injuries.

Mark Owens filed a lawsuit March 24 in Kanawha Circuit Court against Dallas C. Moore Jr., doing business as Moore Trucking, alleging negligence and deliberate intent.

According to the complaint, despite warnings from Owens and his co-workers about worn tires on a Peterbilt dump truck, the defendants failed to have the tires inspected and replaced. As Owens was driving the truck southbound on Interstate 79 on April 16, 2014, the suit says, the left front tire blew out, sending the truck airborne across the median where it struck a rock wall. Owens says he suffered severe, permanent injuries to his shoulder, knee, ribs, sternum and skull.

The plaintiff seeks compensatory damages for pain and suffering, permanent impairment, medical expenses, and scarring and disfigurement. He is represented by attorney J. Christopher Cormany of Cormany Law PLLC in Charleston. Judge Tod J. Kaufman is assigned to the case.
