Man seeks repayment of money allegedly loaned to friend

PHILIPPI – A Barbour County man says a neighbor borrowed $5,000 to help a family member purportedly suffering from cancer but hasn’t repaid the loan.

Jerry Stalnaker filed a lawsuit March 29 in Barbour Circuit Court against Barnett Enterprises Inc., alleging breach of contract.

According to the complaint, on Oct. 3, 2015, Jessie Barnett, principal of Barnett Enterprises, came to Stalnaker’s door, asking for a $5,000 loan for three or four days to help out his daughter who was purportedly suffering from cancer. Stalnaker agreed, the suit says, writing Barnett a check from his coal company account. However, the plaintiff claims that although the agreed amount of time has passed, he has yet to be reimbursed for the loan.

Stalnaker seeks recovery of the entire $5,000 loan amount. He is representing himself.
