Motorist blames two truck drivers for roadside injuries

WHEELING – A Ohio County man and his son are suing the drivers of two tractor-trailers that allegedly struck a vehicle driven by the son as he was pulled over to the side of the road with car trouble.

Richard L. Shunk III, Richard L. Shunk Jr. and Progressive Specialty Insurance (assignee of Richard L. Shunk Jr.) filed a lawsuit April 11 in Ohio Circuit Court against Jeffrey A. Goss, Matheson Postal Services, John Doe and John Doe transportation company, alleging negligence, reckless driving and personal injury liability.

According to the complaint, Richard L. Shunk III was parked on the side of the westbound lane of Interstate 70 with car trouble when Goss struck his vehicle with a tractor-trailer owned by Matheson and then fled the scene, causing injuries and property damage. Another, unknown, tractor-trailer also struck Shunk’s vehicle as it was parked by the roadside, causing additional injuries and property damage, the complaint states. The suit says the Aug. 8, 2014 crashes caused Richard Shunk Jr. property damage and his son, Richard Shunk III, injuries, some of which may be permanent.

The plaintiffs seek a jury trial and punitive and compensatory damages in an amount to be determined at trial. They are represented by attorney Jonathan E. Turak of Gold, Khourey & Turak in Moundsville and by Stephen M. Recht of the Recht Law Offices in Weirton.

Judge James P. Mazzone is assigned to the case.
