POINT PLEASANT – A Mason County couple's lawsuit says that a neighbor is allegedly claiming that a fence long believed to be a legal boundary between their properties is actually invalid.
Clarence E. Williamson and Jorja L. Williamson filed a lawsuit April 13 in Mason Circuit Court against Monty R. Williamson.
According to the complaint, the Williamsons acquired their property in the Arbuckle District of Mason County in 1984, when it was given to them by relatives. Monty Williamson, the suit says, now claims the fence between the property he acquired in the 1990s is not the true property line. The plaintiffs claim Williamson told them his property extends beyond the fence, and that he has been interfering with their use of the property they believe is theirs.
The plaintiffs seeks a judgment establishing the boundary, a restraining order against the defendant to prevent further interference, and monetary damages to compensate for their loss of enjoyment of the property. They are represented by Point Pleasant attorney Damon B. Morgan Jr.
Judge Thomas C. Evans III is assigned to the case.
