Man says casino responsible for disabling injuries

NEW CUMBERLAND – A Pennsylvania man is suing a race track and casino for slip-and-fall injuries he allegedly suffered on the premises.

Anthony Caputo Jr. filed a lawsuit April 12 in Hancock Circuit Court against Mountaineer Park Inc., doing business as Mountaineer Race Track and Gaming Resort; MTR Gaming Group Inc., doing business as Moutaineer Race Track and Gaming Resort; and Eldorado Resorts Inc., doing business as Mountaineer Race Track and Gaming Resort; alleging personal injury liability.


According to the complaint, Caputo was a guest of the defendants at their casino in New Cumberland on Feb. 27, 2015, when he tripped and fell while using the handicapped entrance. The suit says he sustained severe and disabling personal injuries from the fall, allegedly the result of the defendants’ negligence in maintaining safe conditions for casino visitors.

Caputo seeks a jury trial and compensation for ongoing medical costs, mental anguish and aggravation. He is represented by attorney Kevin M. Pearl of the law firm of Frankovitch, Anetakis, Colantonio & Simon in Weirton.

Judge James P. Mazzone is assigned to the case.
