Debtor accuses creditor of telephone harassment

FAYETTEVILLE – A Fayette County man says a company to which he owes money allegedly harassed him with phone calls to collect the debt.

John Vernon filed a lawsuit April 13 in Fayette Circuit Court against Arwood Waste Inc., alleging violations of consumer credit protection laws and invasion of privacy.


According to the complaint, the defendant allegedly placed repetitive phone calls continuously or at unusual times to Vernon in an attempt to coerce him into repaying the debt. The suit says Arwood also contacted Vernon via an electronic communication device, in violation of state consumer protection laws, and intentionally inflicted emotional distress on the plaintiff.

Vernon seeks punitive and compensatory damages in an amount to be proven at trial, as well as reimbursement for litigation costs. He is represented by attorneys Ralph C. Young, Christopher R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville.

Judge Paul M. Blake Jr. is assigned to the case.
