WVU student sues another student over alleged January assault

MORGANTOWN – A Lewis County woman and student at West Virginia University is suing another student she claims assaulted her.

On Jan. 31, Sadeq Abbas Alhakeem assaulted and battered Erin M. Walters, according to a complaint filed April 1 in Monongalia Circuit Court.

Alhakeen willfully, wantonly, intentionally, unjustifiably, recklessly, maliciously, unlawfully or with other like aggravation, assaulted and battered Walters, according to the suit.

Walters claims Alkaheem is subject to the liability for harm he caused her and his actions resulted in bodily harm, as well as emotional distress.

Alhakeem unlawfully committed a violent injury upon Walters and unlawfully made physical contact of an assaulting nature, all without the consent of Walters and, by doing so, violated criminal statutes of West Virginia, according to the suit.

Walters claims she suffered physical pain and suffering of the body and mind; hospital, doctor and medical expenses; humiliation and mental anguish; insult; indignity; emotional distress; grave indignities and embarrassment; annoyance and inconvenience; and other injuries.

Walters is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Bader C. Giggenbach of Brewer & Giggenbach PLLC.
