Motorist sues vehicle owners in injury case

KINGWOOD – A Preston County woman is suing the owners of a commercial vehicle that allegedly struck and injured her in a shopping center parking lot.

Sandra Dietz filed a lawsuit April 22 in Preston Circuit Court against J.R. Excavating LLC, alleging personal injury liability.


According to the complaint, as Dietz was driving a car in the parking lot of the Glenmark Center on July 10, 2014, she was struck by J.R. Excavating’s truck around 3 p.m. The suit says the collision caused Dietz unspecified injuries and alleges that it was a result of gross negligence and reckless driving on the part of J.R. Excavating’s driver. Dietz is suing for medical expenses, loss of enjoyment of life, and pain and suffering.

Dietz seeks a jury trial, compensatory damages and reimbursement for litigation fees. She is represented by attorneys Alex J. Shook and Andrew G. Meek of Hamstead, Williams & Shook PLLC in Morgantown.
