NEW CUMBERLAND – A Hancock County woman is suing a creditor for allegedly failing to release a property lien after the debt was settled.
Stacy Popish filed a lawsuit April 18 in Hancock Circuit Court against GE Money Bank, also known as GE Capital Retail Bank and Convergent Outsourcing Inc., alleging violation of consumer credit laws and the tort of outrage.
According to the complaint, after GE Capital obtained a judgment against Popish for $3,232, including interest and costs, Outsourcing Inc. contacted her to settle the debt for $1,777. Although the plaintiff’s attorney sent Outsourcing the money on Sept. 25, 2013, the suit claims, Outsourcing has refused to release a lien GE Capital had placed against her property, despite three requests through counsel.
Popish seeks a jury trial and punitive and compensatory damages totaling $50,000. She is represented by attorney Michael E. Nogay of Sellitti, Nogay & McCune PLLC in Weirton.
Judge Ronald E. Wilson is assigned to the case.
