Subcontractor accuses coal company of contract breach

BECKLEY – A Raleigh County company says it is still owed more than $100,000 for work it completed under contract.

Fricke Management & Contracting Inc. filed a lawsuit April 27 in Raleigh Circuit Court against Regan & Sierra Management LLC, Bluestone Coal Corp. and Orchard Coal Co., alleging breach of contract, unjust enrichment and enforcement of a mechanic’s lien.


According to the complaint, Fricke Management and R&S struck a deal on May 18, 2015 to relocate a batch weigh system from Vermilion Grove, Ill. to Crab Orchard in West Virginia. Once the project was completed, the suit says Fricke was owed $258,949 for work and materials, but never received payment. After filing a mechanic’s lien against the defendants’ property, Bluestone Coal, an affiliate company, initially agreed to cover the amount owed, but has ceased making payments, the suit alleges.

Fricke Management seeks recovery of the full unpaid amount ($107,689) plus litigation costs. It is represented by attorney Nicholas R. Stuchell of the Daniels Law Firm PLLC in Charleston.
