Energy firms head to court to settle lease dispute

ST. MARYS – A Pleasants County company is suing an energy firm to force the release of funds allegedly promised under a lease agreement.

Willow Run Energy LLC filed a lawsuit April 8 in Pleasants Circuit Court against Golden Eagle Resources II LLC, alleging breach of contract and unjust enrichment.


According to the complaint, Willow Run sold the mineral rights underlying a 225-acre plot in Jefferson district to Golden Eagle on July 24 for $537,597, with the understanding Golden Eagle would pay an additional $221,364 once the title was cleared. However, the suit claims Golden Eagle never paid the reserve amount, even though the title has been settled. 

Willow Run seeks recovery of the reserve amount of $221,364, plus interest and litigation costs. It is represented by attorney M. Paul Marteney of St. Marys.

Judge Timothy Sweeney is assigned to the case.
