Walmart shopper says she slipped on banana peel

CHARLESTON – A Kanawha County woman says she slipped on a banana peel in Walmart’s Cross Lanes store, permanently injuring her knee and ankle.

Judy Lynn Johnson filed a lawsuit April 6 in Kanawha Circuit Court against Walmart Stores Inc., alleging negligence and premises liability.


According to the complaint, as Johnson was shopping in Walmart’s Cross Lanes store on April 13, 2014, she slipped on a banana peel and injured her right knee and ankle. The suit says Walmart breached its duty to provide a safe shopping environment for customers, and is responsible for Johnson’s alleged injuries and medical expenses.

Johnson seeks a jury trial and compensatory damages, plus interest and litigation costs. She is represented by attorney Edward G. Atkins of the law firm of John R. Mitchell L.C. in Charleston.

Judge Charles E. King is assigned to the case.
