Hospital says lessee refused to leave after lease expired

BECKLEY – A West Virginia hospital says a doctor leasing medical office space from them refused to leave when the lease expired.

Raleigh General Hospital LLC filed a lawsuit May 2 in Raleigh Circuit Court against Dr. Mattew K. Nelson.


According to the complaint, in December of 2012 Nelson leased approximately 3,900 square feet from the hospital, with the understanding the lease would terminate on Jan. 31, 2016. However, the suit says Nelson still occupies the space and owes several payments of the $5,500-a-month rent.

The hospital seeks a jury trial, eviction of its tenant, collection of all unpaid rent and recovery of litigation costs and other expenses. It is represented by attorney Gretchen M. Callas of Jackson Kelly PLLC in Charleston.
