Freight company says customer owes $75K in unpaid bills

KINGWOOD – A Preston County company says it hauled machinery and vehicles for a construction industry client, but has never received payment.

BB&T Trucking LLC filed a lawsuit May 5 in Preston Circuit Court against Newmark Construction Inc., alleging breach of contract and unjust enrichment.


According to the complaint, the parties struck several agreements to transport goods, vehicles and machinery to and from various locations in West Virginia and surrounding states in 2015. Although numerous invoices have been presented to the defendant, the suit claims none has been paid.

BB&T Trucking seeks a jury trial and recovery of the full amount allegedly owed, $75,260. It is represented by attorney William C. Brewer of Brewer & Giggenbach PLLC in Morgantown.

Judge Lawrance S. Miller Jr. is assigned to the case.
