Woman sues CrossFit Never Give Up for wage payment violations

CHARLESTON – A woman is suing CrossFit Never Give Up after she claims it violated the West Virginia Wage Payment & Collection Act.

Never Give Up LLC is also known as CrossFit Never Give Up and CrossFit NGU,

Drew Parsons and Tonya Parsons, individually and as members, officers and/or agents of Never Give Up LLC, were also named as defendants in the suit.

Julia Roberts was employed as a Level 1 Certified Trainer by the defendants from Aug. 28, until Jan. 18, according to a complaint filed April 12 in Kanawha Circuit Court.

Roberts claims the defendants had a duty to pay her all employment wages that she was owed pursuant to the West Virginia Wage Payment & Collection Act and breached that duty by failing to pay her wages in a timely manner.

The plaintiff has yet to receive the wages and compensation she is owed, according to the suit.

Roberts claims she received a check in December in the amount of $830.56 and the defendants stopped payment on the check and her bank charged her a $15 fee due to the stop payment order on the check,

The defendants also owe Roberts wages and compensation for what she worked during the month of January, which includes $445 in wages and approximately $100 in sales commissions, according to the suit.

Roberts claims the defendants also failed to return personal property in the form of her CrossFit Certification Diploma, which she paid $500 to obtain certification.

The defendants have, in bad faith, violated the terms and conditions of their employment contract and have caused Roberts damages, according to the suit.

Roberts is seeking compensatory damages with pre- and post-judgment interest. She is being represented by W. Jesse Forbes of Forbes Law Offices PLLC.

The case is assigned to Circuit Judge Louis Bloom.
