Putnam Co. woman sues State Fair for eye injury from dart game

CHARLESTON – A Scott Depot woman is suing the West Virginia State Fair after she claims she suffered an eye injury while attending the fair.

Whatever Enterprises LLC and Reithoffer Shows Inc. were also named as defendants in the suit.

On Aug. 22, Amanda Young was acting as a supervisor for a Boy Scout group outing to the West Virginia State Fair, according to a complaint filed April 13 in Kanawha Circuit Court.

Young claims the rides and games at the fair were not reasonably safe and the defendants negligently provided an unsafe dart game.

While attending the fair with the members of the Boy Scout Troop she was supervising, Young lawfully and properly watched members of the troop participate in a dart game provided and operated by the defendants, according to the suit.

Young claims while she watched one of the Boy Scouts throw a metal-tipped dart as part of the game, the dart ricocheted off the target material and struck her directly in her eye, puncturing her eyeball.

The dart caused Young to sustain severe and permanent injury to her eye, including hemorrhaging of the eye, a permanent defect to the eye and permanent damage to her vision, according to the suit.

Young claims the defendants had a duty to her to provide a safe premises and is directly and proximately liable for causing her injuries by providing an unsafe premises for patrons.

The defendants caused Young to suffer injuries; mental anguish; pain and suffering; loss of enjoyment of life; hospital and medical bills; lost wages; and other damages, according to the suit.

Young is seeking compensatory and punitive damages. She is being represented by John Einreinhofer of the Offices of John Einreinhofer.

The case is assigned to Circuit Judge Charles King.
