Homeowners say house condition report was inaccurate

WHEELING – An Ohio County couple's lawsuit against the previous owner of their home and a real estate agent claims the condition of the home was misrepresented.

Dante A. Lawrence and Marcia J. Lawrence filed a lawsuit May 9 in Ohio Circuit Court against William J. Adel, Gil White and Paull Associates Realty Inc., doing business as Paull Associates Real Estate, alleging fraud and misrepresentation.


According to the complaint, after the plaintiffs closed on their Wheeling property in May 2014, they discovered the house had existing issues with asbestos, radon, water leakage and mold. Although Adel, the previous owner, had completed a five-page property condition disclosure statement, the suit says he neglected to report these issues. The complaint alleges that the real estate agent was also aware of the problems, but failed to inform the defendant.

The Lawrences seek compensatory damages, interest and costs. They are represented by attorney Adam E. Barney of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville.

Judge James P. Mazzone is assigned to the case.
