NEW CUMBERLAND – A Weirton woman is suing Weirton Daily Times after she claims it damaged her reputation.
The Ogden Newspapers Inc. is doing business as Weirton Daily Times.
On May 12, 2015, the defendant published an article that Debbie DeCaria was arrested for destruction of property, which was a false story and was wrong and untrue, according to a complaint filed in Hancock Circuit Court.
DeCaria claims the defendant knew or reasonably should have known that the allegations in the article were false, wrong and untrue based upon the available public record.
The defendant was negligent, careless, reckless, grossly negligent and/or grossly reckless in publishing the newspaper article without ascertaining the truth and accuracy from the available public record, according to the suit.
DeCaria claims caused her damages and humiliation, anxiety, embarrassment, annoyance and inconvenience, emotional distress and other damages to reputation, all of which she continues to suffer, despite the defendant’s attempt at correction.
DeCaria is seeking compensatory damages. She is being represented by Daniel L. McCune of Sellitti, Nogay & McCune PLLC.
