Plumbing company sues WVU for unjust enrichment

MORGANTOWN – One Call Plumbing is suing West Virginia University after it claims the school failed to pay for parts and labor.

West Virginia University Board of Governors and HealthSouth Mountainview Regional Rehabilitation Hospital were also named as defendants in the suit.

One Call provided labor and materials in the construction/improvement of a structure on real estate owned by WVU pursuant to a contract with HealthSouth, according to a complaint filed May 9 in Monongalia Circuit Court.

The plaintiff claims the last date it provided labor and/or materials for the project was Sept. 3.

On Nov. 12, One Call duly filed and later served the defendants a notice of mechanic’s lien against the real estate, according to the suit.

One Call claims the defendants have failed to pay him the outstanding balance for labor and materials used in constructions of and improvements to the real estate.

The defendants have been unjustly enriched at One Call’s expense in the amount of $101,367.93, according to the suit.

One Call is seeking damages in the amount of $101,367.93 with pre- and post-judgment interest. It is being represented by Ramonda C. Lyons and Spencer D. Elliott of Lewis, Glasser, Casey & Rollins PLLC.
