Motorists blame injury crash on other driver’s alleged negligence

MOUNDSVILLE – A Marshall County couple's lawsuit seeks compensation from a driver who allegedly struck their vehicle at an intersection in the county seat.

Ryan Aberegg and Mandy Aberegg filed a lawsuit May 10 in Marshall Circuit Court against William Varnell, alleging reckless driving and negligence.


According to the complaint, on June 5 the Abereggs were traveling on State Route 2 near its intersection with Eighth Street in Moundsville. Varnell allegedly collided with their vehicle, injuring Ryan Aberegg’s leg, arm, shoulder and other areas. The suit claims some of Aberegg’s injuries are permanent, causing pain and emotional anguish, as well as diminishment of his earning capacity.

The plaintiffs seek a jury trial and damages in an amount to be determined by the jury, plus interest and litigation costs. They are represented by attorneys Scott S. Blass and John E. Artimez of Bordas & Bordas in Wheeling.

Judge Jeffrey Cramer is assigned to the case.
