Parents seek permission to accept daughter’s injury settlement claim

BECKLEY – A Raleigh County couple's lawsuit asks a court to approve their acceptance of a personal injury settlement on behalf of their 15-year-old daughter.

Charles and Vickie Cales, on behalf of their minor child Heaven Leigh Cales, filed the motion May 18 in Raleigh Circuit Court to settle a personal injury claim against Raleigh County Parks and Recreation.

According to the complaint, Cales received a cut on her leg July 22 at Lake Stephens. Since Cales has recovered from the injury and no further medical bills are expected, the Cales say they are ready to accept a $2,500 settlement their attorneys have negotiated with the defendant.

The settlement stipulates that the remainder of the funds after court and attorney's fees have been paid are to be placed in an annuity for the child. The Cales are represented by attorney Gerald Hayden of Hayden & Associates L.C. in Beckley
