Company says six-figure payment is overdue on work performed at oil well

CHARLESTON – An excavation firm is suing a client in a dispute involving payment for work on an oil and gas project.

Jimmy A. Dunn Excavating Co. filed a lawsuit May 16 in U.S. District Court for the Southern District of West Virginia, Charleston Division, against Eagle Pipeline LLC, alleging breach of contract.


According to the complaint, Dunn Excavating completed two bore and jack installations for Eagle Pipeline, one on Aug. 14 and the other on Nov. 30. However, the suit claims Eagle has neglected to pay for the work.

Dunn Excavating seeks a judgment of $124,725, plus interest of 1.5 percent each month until the debt is paid. It is represented by attorney Michael J. Giudice of Ciccarello, DelGiudice & Lafon in Charleston.
