Satellite TV provider wants personal injury case heard in federal court

MARTINSBURG – DISH Network, the defendant in a personal injury case, has petitioned to remove the lawsuit from state to federal court.

The motion was filed May 20 in U.S. District Court for the Northern District of West Virginia.


In the original complaint, William Shope accused DISH Network of liability for injuries he suffered during the July 23, 2015 installation of the TV service at his house. The suit claims a ladder fell and struck Shope, allegedly because it was improperly secured.

DISH Network argues that the case falls under federal jurisdiction because the parties are in different states and the amount in controversy is more than $75,000.

Shope seeks a jury trial and compensatory damages for his pain and suffering and medical expenses. He is represented by attorney M. Eric Frankovitch of Frankovitch, Anetakis, Colantonio & Simon in Weirton.
