Worker claims he was fired for alleged whistleblowing

CHARLESTON – A Roane County man says he was fired after reporting alleged on-the-job drug and alcohol use among co-workers.

Richard P. Kerns filed a lawsuit April 25 in Kanawha Circuit Court against Cunningham Energy LLC, doing business as Cunningham Oilfield Services, and Ryan E.M. Cunningham, individually and as manager of Cunningham Energy, alleging retaliatory discharge.


According to the complaint, Kerns was terminated May 2, 2014 after telling supervisors some of his co-workers were allegedly under the influence of drugs and/or alcohol while on the job.

Kerns seeks a jury trial, punitive and compensatory damages, interest and litigation costs. He is represented by attorney Travis A. Griffith of Griffith Law Center PLLC in Charleston.

Judge Joanna Tabit is assigned to the case.
